Copyright change refers to alterations in the subject of rights, content of rights, and other aspects during the term of copyright.
According to the basic principle of the exclusive nature of the author's moral rights, the author's moral rights are closely connected with the author's person. Except in cases where the parties agree or the law explicitly stipulates that others may exercise the moral rights on behalf of the author, the subject of the author's moral rights cannot be changed.
Therefore, the copyright that can undergo changes is essentially the author's property rights.
There are two main ways to change copyright: contractual and statutory.
Situations where copyright changes occur through contractual agreements are frequent in social life. The higher the level of rule of law in a country, the more it encourages people to transfer rights through contracts, which is closely related to the legal concept of protecting people's freedom and rights.
Copyright changes through legal means, such as the partial rights in the copyright enjoyed by legal persons over the works made for hire by natural person authors, represent such a scenario. This is a legislative manifestation of the law's concept of achieving equitable protection of the rights of different subjects.
Change Materials
I. Original work copyright registration certificate.
2. A copy of the right holder's business license or ID card, stamped with the official seal or signed.
III. Draft the "Change Specification".
IV. Sample of the work should be consistent with that submitted at the time of original registration.
V. If the name or address of the right holder changes, a change certificate issued by the industrial and commercial department or an identity change certificate issued by the public security bureau must be presented.
Change Process
The applicant submits registration application materials—the registration agency verifies and receives the materials—notifies payment—the applicant pays the registration fee—the registration agency accepts the application—reviews—produces and issues the registration certificate—announcement.
